This paper examines treason (uhaini) as the gravest offense against the United Republic of Tanzania under Article 28 of the Constitution and Section 39 of the Penal Code. It explores the statutory definition of treason, its essential elements—unlawfulness, hostile intention, allegiance, and overt acts—and the corresponding death penalty prescribed by law. The discussion situates treason within the broader framework of constitutional order, national security, and legal pluralism, emphasizing its role in safeguarding sovereignty and political stability.

By synthesizing statutory provisions and judicial precedents, the paper contributes to ongoing debates on the scope of treason, the threshold for criminal liability, and the balance between protecting state authority and ensuring fair trial standards in Tanzania’s legal system.
