Viksit Bharat @ 2047: Crafting A Future-Ready Ip Regime For A Developed India

The vision of ‘Viksit Bharat @ 2047’-transforming India into a developed nation by the centenary of its independence-is a monumental national ambition that extends beyond mere economic metrics. It signifies a profound transition from a factor-driven economy to a global powerhouse of innovation, knowledge, and creativity. This article posits that at the very fulcrum of this transformation lies a critical, yet often underestimated, catalyst: a sophisticated, strategically aligned, and future-ready Intellectual Property (IP) regime. IP is not a peripheral legal concern but a foundational pillar for achieving the multifaceted goals of Viksit Bharat, including sustained economic growth, technological sovereignty, inclusive social development, and cultural assertion on the world stage. The current Indian IP framework, despite significant strides made since the turn of the century and the launch of the 2016 National IPR Policy, requires a deep, structural overhaul to meet the demands of a developed economy and the existential challenges posed by disruptive technologies like Artificial Intelligence and quantum computing. This article evaluates the existing regime against the key pillars of the Viksit Bharat vision, arguing for a paradigm shift from a ‘Make in India’ narrative, focused on manufacturing, to a more ambitious ‘Create, Own, and Monetise in India’ paradigm. It delves into the specific needs of the startup ecosystem, the role of IP in attracting high-value R&D investment, the imperative of a dedicated trade secrets law, the complexities of Standard Essential Patents, and the urgent need to move beyond defensive protection for India’s vast traditional knowledge. To address these challenges, a detailed ten-point action plan is proposed as a roadmap for reform. This includes launching a new National IPR Policy 2.0, establishing a specialised National IP Appellate Tribunal to ensure swift and expert justice, enacting a comprehensive trade secrets law, creating a sui generis framework for the positive protection of traditional knowledge, and deeply integrating IP metrics into the nation’s core industrial and trade policies. Ultimately, crafting a world-class IP regime is presented as an indispensable act of economic and strategic nation-building, crucial for navigating the complexities of the 21st-century global order and realising the dream of a developed, innovative, and intellectually sovereign India by 2047.
