Abstract
This chapter explains Article 49 of the 1986 Vienna Convention on the Law of Treaties (VCLT), which deals with fraud. In relation to Article 49 of the 1969 Vienna Convention, Article 49 of the 1986 Vienna Convention contains only two drafting modifications. The first consists in extending the provisions relating to fraud to international organizations. The second modification is that, in the new Article 49, an affirmative formulation was preferred to the hypothetical formulation of the same Article in the 1969 Convention, in the interest of clarity and precision. On the substance, however, the rule is the same, so that all the commentaries on Article 49 of the 1969 Vienna Convention can be fully transposed here.
