1986 Vienna Convention

Abstract This chapter evaluates Article 39 of the 1986 Vienna Convention on the Law of Treaties (VCLT), which deals with the general rules regarding the amendment of treaties. The first paragraph of Article 39 of the 1986 Convention on the Law of Treaties between States and International Organizations is exactly the same as Article 39 of the 1969 Vienna Convention. No additional commentary is therefore required. Despite the fact that the 1986 Vienna Convention has not yet entered into force, the rule in Article 39 has been invoked as the legal basis for proposed amendments to conventions whose parties include international organizations. The second paragraph of Article 39 of the 1986 Convention sets out a rule that is enunciated several times in other parts of the 1986 Convention, according to which the expression of consent of the organization to be subject to a treaty rule will be governed by the rules of that organization.
