Analisis Fikih Muamalah tentang Hadiah Bersyarat Melalui Cashback di E-Commerce Lazada

Abstract. Lazada implements various strategies to attract consumers, one of which is providing various attractive promos such as free shipping, discounts, and cashback. The purpose of this study is to find out the practice of conditional gifts through cashback in Lazada e-commerce and review the muamalah fiqh of this practice. This type of research uses primary data and secondary data with a phenomenological qualitative approach. Methods of data collection through library research, interviews, and documents so that data analysis can be carried out using normative juridical analysis. The results of this study indicate that in the practice of conditional gifts through cashback on Lazada, buyers must meet predetermined requirements, namely minimum spending of a certain amount. If these conditions are met, you will get cashback in the form of a balance. According to a muamalah fiqh review, conditional gifts through cashback on Lazada e-commerce are permissible as long as these conditions do not violate the principles and principles of muamalah fiqh, do not violate the provisions in the terms and pillars of transactions, do not involve elements that are forbidden, such as gambling, usury, gharar, maysir, and fraud and both parties are happy with each other. Abstrak. Lazada menerapkan berbagai strategi untuk menarik konsumen, salah satunya memberikan berbagai promo menarik seperti gratis ongkir, diskon, dan cashback. Tujuan penelitian ini untuk mengetahui praktik hadiah bersyarat melalui cashback di e-commerce Lazada dan tinjauan fikih muamalah terhadap praktik tersebut. Jenis penelitian ini menggunakan data primer dan data sekunder dengan pendekatan kualitatif fenomenologi. Metode pengumpulan data melalui studi kepustakaan, wawancara dan dokumen agar dapat dilakukan analisis data menggunakan analisis yuridis normatif. Hasil penelitian ini menunjukkan bahwa praktik hadiah bersyarat melalui cashback di Lazada pembeli harus memenuhi persyaratan yang telah ditentukan, yaitu minimal belanja dengan jumlah tertentu.  Apabila syarat tersebut terpenuhi, maka akan mendapatkan cashback berupa saldo dan mendapatkan potongan harga. Menurut tinjauan fikih muamalah hadiah bersyarat melalui cashback di e-commerce Lazada diperbolehkan selama syarat-syarat tersebut tidak melanggar prinsip dan asas fikih muamalah, tidak melanggar ketentuan dalam syarat dan rukun transaksi, tidak melibatkan unsur yang diharamkan, seperti perjudian, riba, gharar, maysir, dan penipuan serta kedua pihak saling rida.
