The aim of this chapter is to challenge two common conceptions regarding legislation and law enforcement’s potential in combatting crime, based on examples of non-consensual sharing of intimate images, psychological violence and minor cases of violence in close relationships in Denmark. The first conception is the belief that the court can solve society’s problems – what is known as legal optimism. Legal optimism stems from the belief that people’s actions can be steered through law and enforcement. The second conception is the view that a new or stricter law in a given penal field will better serve the victims of a given crime. The chapter points to some important limitations in legal solutions.
