העצמאות השיפוטית כרכיב מרכזי באתיקה שיפוטית Judicial Independence as a Core Component of Judicial Ethics

<p dir="rtl"><b>תקציר בעברית: </b>מאמר זה בוחן את מהותה של האתיקה השיפוטית, את מאפייניה הייחודיים ואת תכליותיה, הן ביחס לאופייה המיוחד של הפעילות השיפוטית והן ביחס לאתיקה במקצועות אחרים. הניתוח מאמץ גישה בין־תחומית, הנשענת על מקורות פילוסופיים ומשפטיים כאחד, לרבות פסיקה עדכנית של בית המשפט העליון בישראל. הטענה המרכזית של המאמר היא כי יש להבין את העצמאות השיפוטית כרכיב יסודי ומרכזי באתיקה השיפוטית. טענה זו נבחנת לאור חקיקה, פסיקה וספרות מחקרית בישראל ומחוצה לה. המאמר מצביע על כך שהעצמאות השיפוטית לא זכתה לתשומת לב מספקת כעיקרון אתי, בין היתר בשל תפיסה מושגית הרואה בה אך ורק ביטוי לחירות או לזכות, בעוד שאתיקה נתפסת בדרך כלל כמערכת של חובות והתחייבויות. ואולם, בהבנה נכונה, העצמאות השיפוטית אינה רק חירות אלא גם חובה, והאתיקה אינה מצטמצמת למכלול של חובות אלא עוסקת גם במימושה של העצמאות כצורה של הגשמה מקצועית. לפיכך מסיק המאמר כי יש למקם את העצמאות השיפוטית בלב האתיקה השיפוטית, כרכיב מכונן וחיוני של התפקיד השיפוטי<br><br></p><p dir="ltr"><b>English Abstract: </b>This article examines the nature of judicial ethics, its distinctive characteristics, and its purposes in relation to the specific nature of judicial activity and to ethics in other professional fields. The analysis adopts an interdisciplinary approach, drawing on both philosophical and legal sources, including recent decisions of the Israeli Supreme Court. The central thesis of the article is that judicial independence should be understood as a fundamental and central component of judicial ethics. This claim is examined in light of legislation, case law, and scholarly literature in Israel and abroad. The article argues that judicial independence has often received insufficient attention as an ethical principle, partly due to a conceptual misunderstanding that views independence solely as a form of liberty or right, whereas ethics is commonly associated with duties and obligations. Properly understood, however, judicial independence is not merely a freedom but also a duty, and ethics is not limited to a set of obligations but also concerns the realization of independence as a form of professional self-fulfillment. Accordingly, the article concludes that judicial independence should be placed at the center of judicial ethics as a defining and indispensable element of the judicial role.</p>
