KAJIAN HUKUM RPTRA JAKARTA BAGI AKSES RUANG UMUM DI DAERAH PADAT

The development of Child-Friendly Integrated Public Spaces (RPTRA) in Jakarta is a policy that aims to provide open spaces for the community, especially children, in order to realize Jakarta as a Child-Friendly City. The existence of RPTRA is regulated in the Regulation of the Governor of DKI Jakarta Province Number 123 of 2017, which regulates the standards for the development, management, and utilization of RPTRA. However, in its implementation, various legal problems have emerged, especially in terms of the inconsistency of RPTRA functions with Green Open Space (RTH) standards, funding transparency, and weak monitoring mechanisms. RPTRA is often categorized as part of RTH, but in practice, the main function of RPTRA is more oriented towards social and community activities than environmental conservation. This is contrary to Law Number 26 of 2007 concerning Spatial Planning, which stipulates that RTH must be dominated by vegetation of at least 60% of the total land area. Several case studies in Jakarta show that most RPTRAs have a very limited proportion of vegetation, because most of the land is used for the development of social facilities, such as multipurpose buildings, playgrounds, and community economic areas. In addition, in terms of funding, RPTRAs rely heavily on Corporate Social Responsibility (CSR) from private companies. Although regulations stipulate that this source of funding must be managed transparently, in practice, there is no clear mechanism to oversee the allocation and use of CSR funds in RPTRA development. Weak supervision of RPTRA management is also a serious challenge. Although regulations mandate supervision by the relevant Regional Work Units (SKPD), in practice many RPTRAs experience a decline in the quality of their facilities due to a lack of ongoing maintenance. Therefore, a more assertive policy revision is needed to ensure that RPTRAs not only function as social spaces, but also meet ecological standards as part of green open space. The government also needs to tighten supervision of RPTRA funding and governance, so that these facilities can truly provide benefits to the community without sacrificing the function of the urban environment.
