Spotkania informacyjne z perspektywy sędziego i mediatora

INFORMATIONAL MEETINGS FROM THE PERSPECTIVE OF A JUDGE AND MEDIATOR: A CONTRIBUTION TO THE DISCUSSION This study contributes to the discussion on investigating the cause of the low rate of informational meetings organized in courts and the impact of this phenomenon on the low number of court cases directed to mediation. The authors examined the appropriateness of organizing informational meetings and then presented a methodology for their organization in a convenient manner for the parties and facilitators. The issue will be addressed from two perspectives – firstly, that of an actively practicing judge who utilizes informational meetings in non-litigious civil cases, and secondly, that of a court mediator who conducts informational meetings at the request of the courts. The authors presented typical practical problems related to the organization of informational meetings and proposed ways to address them. The issues raised are particularly significant due to the lack of detailed research on this topic and limited literature in this area. The paper presented conclusions regarding whether it is worth organizing informational meetings, how to do so, and the impact of organizing informational meetings on the further course of court proceedings, the number of cases directed to mediation, and the overall number of court cases. Of course, this study, due to its limited scope, does not claim to be exhaustive. Its aim is merely to outline the titular topic and the related problems.
