Il contratto di affidamento fiduciario: fra revocatoria ordinaria e simulazione (Trib. Ascoli Piceno, 19 agosto 2024)

Tesi Il Tribunale di Ascoli Piceno, per la prima volta nel panorama giurisprudenziale italiano, ha riconosciuto l’esperibilità del rimedio revocatorio ordinario e dell’azione di simulazione avverso un contratto di affidamento fiduciario. Quest’ultimo infatti prevede la costituzione di un vincolo sui beni di proprietà dell’affidante capace di produrre una segregazione patrimoniale e di imprimere ai beni affidati una destinazione tale da sottrarli alla garanzia generica dei creditori quand’anche si fondi su un profondo valore etico e morale. Stante l’insuccesso del DDL Riccardi e la mera menzione dell’istituto nella legge sul Dopo di Noi, la sentenza segna un ulteriore passo in avanti nel riconoscimento del negozio in Italia. The author’s view The Court of Ascoli Piceno, for the first time in the Italian jurisprudential panorama, recognized the availability of the ordinary revocatory remedy and of the action of simulation against a fiduciary entrusting contract. The latter in fact provides for the establishment of a lien on the assets owned by the trustee capable of producing asset segregationand to give the entrusted assets a destination such as to remove them from the generic guarantee of creditors, even if it is based on a profound ethical and moral value. Given to the failure of the Riccardi’s Bill and the mere mention of the institution in the law on “After Us”, the sentence marks a further step forward in the recognition of the contract in Italy.
