La giurisdizione in materia successoria. Il 'caso Hallyday'

Tesi Il Reg. UE n. 650/2012 ha adottato un unico criterio che definisce sia l’autorità sia la legge applicabile di default a una successione transfrontaliera: la residenza del defunto. Sono le autorità giurisdizionali dello Stato in cui si trova la residenza abituale del de cuius al momento della morte, ad essere munite di competenza sull’intera successione ed è la legge del medesimo Stato a regolare tutta la vicenda successoria. Sul concetto di residenza abituale come inteso dal Reg. UE n. 650/2012 verte il contenzioso ereditario che ha visto coinvolti gli eredi di Johnny Hallyday. La decisione del giudice francese è la conferma che la valutazione complessiva delle circostanze spetta all’autorità che si occupa della successione, tenendo presente che – nell’ottica del regolamento – collocare la residenza abituale del defunto al momento della morte in più Stati membri comporterebbe una frammentazione della successione. The author’s view EU Reg. 650/2012 has adopted a single criterion defining both the authority and the law applicable by default to a cross-border succession: the residence of the deceased. It is the courts of the State in which the deceased's habitual residence at the time of death is located that have jurisdiction over the succession as a whole and it is the law of that State that governs the entire succession. The concept of habitual residence as understood by EU Reg. 650/2012 is the subject of the inheritance dispute involving the heirs of Johnny Hallyday. The decision of the French court is a confirmation that the overall assessment of the circumstances is a matter for the authority dealing with the succession, bearing in mind that - in the perspective of the regulation - placing the habitual residence of the deceased at the time of death in several Member States would lead to a fragmentation of the succession.
