Gli artt. 7, n. 6, e 25, par. 3, del regolamento Bruxelles I bis sulla competenza giurisdizionale e il riconoscimento delle decisioni in materia civile e commerciale pongono norme di giurisdizione specificamente rivolte al trust. Nelle controversie relative a questo istituto, le questioni di giurisdizione non riguardano però soltanto il funzionamento di tali disposizioni, ma spesso sollevano ulteriori problemi, tra cui: la possibilità di invocare il foro speciale previsto dall’art. 8, n. 1 (cumulo soggettivo); l’efficacia di clausole di giurisdizione a favore di giudici di Stati terzi contenute in atti istitutivi di trust e la delimitazione dell’ambito applicativo del reg. Bruxelles I bis rispetto a quello degli altri regolamenti di diritto internazionale privato dell’Unione Europea.

Arts 7(6) and 25(3) of the Brussels Ia regulation on jurisdiction and the recognition of judgments in civil and commercial matters contains jurisdiction rules specifically addressed to trusts. Trust disputes do not involve these provisions only, but often raise additional jurisdictional problems, including: the possibility of invoking the special forum provided for in Article 8(1) in the case of multiple defendants; the potential derogation from national jurisdiction in favour of the courts of a third State by virtue of a clause in the trust instrument; and the delimitation of the scope of application of the Brussels Ia Regulation from that of other private international law regulations of the European Union.
