Punishing Mobility in Europe

Abstract
Understanding and analyzing the punishment of mobility in Europe entails looking at the interconnectedness of the European scale and the national scale of different European member states. By paying attention to the dynamics between these scales against a larger sociopolitical discourse in which migration is both politicized and securitized, this chapter illustrates how this has given rise to the development of national practices of abnormal justice across Europe, generating new forms of inequality for noncitizens. These practices are indicative of the creation of parallel penal systems for citizens and for noncitizens whereby the latter are characterized by different procedural and substantive standards of justice. The chapter illustrates the development of these practices, as well as the inextricable connection between the European and the national in giving rise to them, by presenting three case studies. The chapter ends with broader reflections on punishing mobility in Europe and highlights several avenues for further research.
