35. Injunctions

This chapter focuses on injunctions. Injunctions normally operate to prevent a person acting in a particular way (although they can also be used to require a person to act positively to put right a wrong). Injunctions can be used for a wide variety of purposes, and their scope has evolved considerably over the years. The late twentieth century saw the development of freezing and search orders. This century has seen the emergence of privacy orders, superinjunctions, and notification orders. More traditionally, injunctions have been used to prevent breaches of contract or breaches of restrictive covenants affecting land or to restrain the continuation of a public or private nuisance.
