Theoretical and legal issues of participation of the prosecutor in criminal proceedings

В статье рассматриваются вопросы участия прокурора в уголовном процессе, его основные полномочия во время судебного разбирательства в соответствии с УПК РФ. Говорится, что прокурор защищает государственные и общественные интересы в судебном разбирательстве. Прокурор включается в уголовный процесс после того, как получит сведения о преступлении, продолжая деятельность вплоть до пересмотра приговора, вступившего в законную силу. Каждая стадия уголовного процесса проходит при участии прокурора. Перечисляются наиболее важные проблемы участия прокурора в уголовном процессе и возможные пути их решения. Особое внимание уделяется изменениям и поправкам, внесенным в Конституцию РФ в 2020 году, согласно которым полномочия прокурора получили новое развитие. Была расширена компетенция прокурора с целью повышения эффективности его деятельности. Сделаны выводы о необходимости решения перечисленных проблем, возникающих при участии прокурора в уголовном процессе, восстановить ряд имевшихся у прокурора полномочий на досудебных стадиях уголовного процесса.
