Bail

This chapter examines the powers and duties given to custody officers and the courts to grant bail in criminal proceedings. It highlights how Bail may be granted unconditionally or conditionally. Custody officers will generally release people on bail before charges to return to a police station or after charges to a magistrates' court. The Bail Act 1976 provides that people who either fail to answer bail or breach their conditions of bail, may be arrested. Meanwhile, Article 5 of the Human Rights Act 1998 ensures that detainees are not given erroneous bail conditions or where sureties are demanded that they are reasonable.
