This research study provides an analytical review of the application of Mudarabah, Musharakah, and Ijarah in Islamic banking and the jurisprudential (Fiqhi) differences associated with these contracts, along with their practical implications. Islamic banking is fundamentally based on Shariah principles, and these contracts are structured around the principles of capital, labor, profit, and loss sharing. However, due to differing jurisprudential interpretations and historical perspectives among various schools of thought, divergences arise in their practical implementation.The study examines the Fiqhi concepts, historical background, and practical application of Mudarabah, Musharakah, and Ijarah. It highlights how different schools of thought adopt varied approaches regarding profit and loss distribution, remuneration, contract duration, and allocation of responsibilities. The research also identifies the underlying causes of these differences, such as jurisprudential interpretations (Ijtihad), contemporary banking requirements, economic conditions, and contractual safeguards.Furthermore, the study explores the practical challenges and issues in Islamic banking, including lack of contractual transparency, unequal distribution of risks, deficiencies in legal and ethical safeguards, and administrative complexities. It also presents international experiences and best practices, demonstrating how Shariah principles can be harmonized with modern banking requirements.The findings indicate that Fiqhi differences not only hold theoretical significance but also directly affect the transparency, efficiency, and stability of practical banking operations. The study recommends that Islamic banking contracts should be designed to be transparent, legally sound, and Shariah-compliant, enabling both adherence to jurisprudential principles and effective practical implementation. This research provides guidance for safeguarding the rights of banks, investors, and customers, while promoting a transparent and stable financial system.
