1986 Vienna Convention

View through CrossRef
Abstract This chapter examines Article 69 of the 1986 Vienna Convention on the Law of Treaties, which outlines the consequences of a treaty’s invalidity. It asserts that invalid treaties are void and lack legal force, while acts performed in good faith before the invocation of invalidity remain lawful. The chapter highlights that parties must attempt to restore the status quo in mutual relations if actions are taken based on a void treaty. It explains that cases involving fraud, corruption, or coercion impose stricter rules, penalising wrongful acts regardless of invalidity. The chapter underscores that the norms remain consistent with the 1969 Convention, extending to international organisations without altering the core principles despite interpretative challenges.
