Analisis Fatwa DSN MUI No: 75/DSN MUI/VII/2009 terhadap Multilevel Marketing (MLM) Suplemen Kesehatan Tianshi

Abstract. This research aims to analyze the Multilevel Marketing (MLM) system of Tiens health supplement products from a sharia perspective, specifically referring to the DSN-MUI Fatwa No. 75/DSN-MUI/VII/2009 on Sharia-Compliant Direct Selling (PLBS). The study focuses on the mechanisms of product sales, member recruitment, and the distribution of bonuses and commissions within the Tiens network. A normative juridical approach was used, supported by empirical data obtained through direct observation and interviews with active distributors and official stockists in Bandung. The findings indicate that Tiens operates through direct selling methods, both online and offline, requiring registration, and product purchases for membership. Bonuses and commissions are granted based on actual sales performance and team development, rather than merely recruiting new members. The products sold are certified halal and licensed by the national food and drug agency (BPOM). Based on the analysis of fatwa requirements, the Tiens system aligns with sharia principles, as it does not involve elements of uncertainty (gharar), interest (riba), gambling (maysir), or money game practices. The study concludes that Tiens MLM practices, as observed in the field, are acceptable under Islamic law and national regulations, provided the focus remains on real product sales and the system upholds fairness and transparency. Penelitian ini bertujuan untuk menganalisis sistem Multilevel Marketing (MLM) pada penjualan suplemen kesehatan Tiens dari perspektif syariah, khususnya berdasarkan Fatwa DSN-MUI No. 75/DSN-MUI/VII/2009 tentang Penjualan Langsung Berjenjang Syariah (PLBS). Permasalahan yang dikaji meliputi mekanisme penjualan, sistem perekrutan anggota, serta skema bonus dan komisi yang diterapkan dalam jaringan Tiens. Penelitian ini menggunakan pendekatan yuridis normatif dengan penguatan data empiris melalui observasi dan wawancara langsung dengan distributor aktif serta pihak stockist resmi di Kota Bandung. Hasil penelitian menunjukkan bahwa sistem pemasaran Tiens dijalankan melalui metode penjualan langsung, baik secara daring maupun luring, dengan kewajiban pembayaran pendaftaran dan pembelian produk sebagai syarat keanggotaan. Bonus dan komisi diberikan berdasarkan hasil penjualan serta pembinaan jaringan, bukan semata-mata dari perekrutan. Produk yang dipasarkan memiliki sertifikasi halal dan izin edar BPOM. Berdasarkan analisis terhadap ketentuan fatwa, sistem Tiens dinilai memenuhi prinsip-prinsip syariah karena tidak mengandung unsur gharar, riba, maysir, maupun praktik money game. Simpulan dari penelitian ini menyatakan bahwa praktik bisnis MLM Tiens, sejauh yang diamati di lapangan, dapat dibenarkan secara syariah dan legal formal selama tetap berfokus pada penjualan produk yang nyata dan menjaga etika keadilan serta transparansi dalam sistem distribusi.
