50 GODINA USTAVA SFRJ IZ 1974. GODINE – PROCES KOJI NIJE OKONČAN?

In this paper, the author tries to answer some questions that, in his opinion, do not represent general points about the Constitution of the SFRY from 1974. Therefore, he tends to give a different review of this constitution, about which it seems that everything has been said a long time ago. His key thesis is that there are historical constitutions, that is, constitutions that long ago ceased to be formally and legally valid, but which still, even indirectly, produce certain socio-political and cultural consequences in a political community. Hence, they are not, in the true sense, part of the constitutional past of a country. According to the author, the Constitution of the SFRY from 1974, which officially started the process of disintegration in the former Yugoslav territory, is like that, which has not ended, primarily considering the unresolved final legal status of Kosovo and Metohija. Instead of a conclusion, he provides a division of historical constitutions, which, among other things, serves a better understanding of the border and relationship between the constitutional past and the constitutional present.
