Title: Legitimacy Law
Description:

Its core claim is that one of public law’s principal functions is to secure a minimum degree of legitimacy for exercises of governmental power, whether in administrative decision-making, legislation, or constitutional enactment and amendment.
Drawing on the literature on legitimacy, the Article distinguishes sociological legitimacy from three principal forms of normative legitimacy: democratic legitimacy, derived from the connection between governmental power and representative institutions; procedural legitimacy, derived from the process through which a decision is made; and epistemic legitimacy, derived from the decision-maker’s professional or institutional epistemic position.

This analysis suggests that constitutional and administrative law should be understood not merely as distinct bodies of law that influence one another, but as manifestations of a shared normative project: establishing the conditions under which governmental power may claim sufficient legitimacy.

Both the relevant form of legitimacy and the level demanded vary according to the nature of the governmental act, its place in the normative hierarchy, and its consequences.
Finally, the Article develops the idea of an “economy of legitimacy,” under which different forms of legitimacy may, in certain circumstances, interact and partially compensate for one another, subject to a minimum threshold of democratic legitimacy that cannot be displaced.
The resulting account presents legitimacy as an organizing principle for substantial parts of public law without claiming to offer a comprehensive or monistic theory of the field.
