"Codification Historical Perspective and Current Importance”

Abstract:<br>The process of Codification of laws is a systematic compilation of laws and statutes with the purpose to establish a standardized source of compiled laws for informal access of general public. The History Reveals that the laws in ancient era during Egyptian rules was available in piecemeal and scattered manner, these laws were first time setting in the form of a code known as <b><i>Sumer’s Code </i></b><i>in 2050 BC. </i>The <b>Code of Hammurabi, </b>the <b>Tang Code</b> and<b> </b>the <b>French Napoleonic Code</b> (1804) were also a significant example of codification of laws.&nbsp; In <b>19^th Century</b>, the huge work of codification of Sharia laws and use of civil codes in Sharia was adopted by the <b>Ottoman Empire</b>. With the passage of time, the compilation of laws become integral for creation of law-abiding society. Likewise, for the purpose of systematic compilation of all implemented international standards, customs and guidelines, the International Conventions and guidelines were preserved in written format by the League of Nations. The modern laws and rules are mostly in written format and a codified system of law is fundamental for the development of Rule of law, it promote clarity and accessibility. The process of Codification in modern era requires preliminary identification of subject, classification and selection of laws, compilation, creation of sections and chapters, publication of Code and dissemination of the same to make it accessible for the readers. In modern era of globalization and technology advancement, the laws and customs are no more unwritten, which restricted the work of compilation of relevant laws, rules and regulations to compile the laws on a specific subject in one code/document to facilitate the readers and researchers to get all the information in one book or code. The process of codification of laws on any selected subject must requires to be thoroughly researched-based, the updated laws need to be selected in careful manner and the collection of law need to be comprehensive and user friendly.
