Jurisprudential issues based on interpretative disagreement in determining the reference of a (Al-lafz) term from what came before it, an applied jurisprudence study

This research revolves around the applied jurisprudence studies that trace the effects of differing views and the diversity of intakes. Desiring to contribute to the industry of the jurist who has the ability to analyze the text with his tools that enable him to confront every new issues and not stand - helpless, since jurisprudence is not only a collection of issues, but rather it is a talent that must be acquired through training by induction, consideration and application on the legal texts and their treatment and deduction of rulings from them in a manner that is hoped to be approached in this research. Therefore, this research will address - by inductive collection and analysis - some manifestations of the doctrinal disagreement stemming from the explanatory disagreement of the text, and it included an introduction, a preface, four sections and a conclusion, according to the following: The introduction consists of the definition of the subject, its importance, and plan. And the preface with an explanation of the title and a statement of the impact of the nature of language on the doctrinal disagreement. The first topic is in the different jurisprudential issues in which according to the explanatory disagreement of the reference of the (Al-lafz) the term in (Al-ibadat) worshiping, I present in it the collection and jurisprudence study of the applications falling under the chapters of worship, which differed in their ruling according to the difference in defining the meaning and arising from the reluctance to specify its reference from what came before it.The second topic is in the disagreed jurisprudential issues in which according to the explanatory disagreement of the reference of the (Al-lafz) the term in (Al-muamalaat) transactions, in it I exposed the collection and the jurisprudential study of the applications falling under the chapters of transactions, which differed in its ruling according to the difference in determining the meaning and arising from the hesitation in specifying its reference from what preceded it.And the third topic is in the disagreed jurisprudence issues in which according to the explanatory disagreement of the reference of the (Al- lafz) the term in the rulings of family, in it I exposed to the collection and the jurisprudential study of the applications falling under the chapters of family jurisprudence, which differed in its ruling according to the disagreeing in defining the meaning and arising from the reluctance to specify its reference from what came before it.The fourth topic deals with various doctrinal issues, according to the explanatory disagreement of the reference to (Al-lafz) the term in criminal and judicial matters, in it I exposed to the collection and the jurisprudential study of the applications falling under the chapters of felonies and the judiciary, which differed in its ruling according to the disagreeing in the interpretation of the reference to the word in crimes and the judiciary. Then the research was concluded with the most important findings, and then proved a list of the research sources and references.
