Mineral royalties on by-product metals: Judicial practice

The relationship between a state's subsoil resources and the distribution of resource wealth has been extensively examined across a range of disciplines, including philosophy, economics, political economy, geology, law. and tax studies. Nevertheless, the allocation Of resource wealth remains a contested issue in both theory and practice.If royalties are understood as payments arising from the state's ownership rights over subsoil resources, it is insufficient to regard the existence of actual income or economic benefits derived from mineral extraction as the sole critenon for imposing such payments. However, existing studies in Mongolia concerning the imposition of mineral royalties on by-product metals have primarily focused on economic benefits and tax principles, while the legal foundations of state ownership of natural resources and the principle of Permanent Sovereignty over Natural Resources (PSNR) have received insufficient attention.This study examines the issue through a comparative analysis of natural resource ownership theory, the PSNR principle, the Regalian doctrine, and royalty regimes in selected jurisdictions. The findings indicate that the imposition Of mineral royalties on by-product metals may be justified within the framework of property rights and state sovereignty. irrespective of whether the extraction activity generates direct economic benefits. The study further demonstrates that the theoretical foundations of royalty systems and their implementation models may legitimately vary depending on a state's policy choices, constitutional obJectives and principles, and the legislative framework adopted by the lawmaker.This research contributes to the theoretical and practical development of the legal regulation Of mineral royalties in Mongolia and provides a foundation for further discussion on the legal basis for imposing royalties on by-product metals. Роялтиг газрын хэвлийн баялгийг ашиглуулахтай холбоотой төрийн өмчлөгчийн эрхээс үүдэлтэй төлбөр гэж үзвэл тухайн ашигт малтмалын олборлолтоос бодит орлого олсон эсэх, эсхүл эдийн засгийн үр ашиг бий болсон эсэхийг төлбөр ногдуулах цорын ганц шалгуур болгон тайлбарлах нь учир дутагдалтай юм. Гэвч Монгол Улсад дагалдах металлаас ашигт малтмалын нөөц ашигласны төлбөр ногдуулах асуудлыг судалсан бүтээлүүдэд гол төлөв эдийн засгийн үр ашиг болон татварын зарчмууд давамгайлж, байгалийн баялаг дахь төрийн өмчлөлийн онол болон эзэн орны байнгын бүрэн эрхийн зарчмын (PSNR) эрх зүйн үндэслэл хангалттай судлагдаагүй байна.Судалгаанд байгалийн баялгийн өмчлөлийн онол, PSNR зарчим, Regalian номлол, мөн бусад улсын роялтийн зохицуулалтыг харьцуулан авч үзсэн болно. Судалгааны үр дүнд дагалдах металлаас ашигт малтмалын нөөц ашигласны төлбөр ногдуулах нь зөвхөн эдийн засгийн үр ашиг бий болсон эсэхээс хамаарахгүйгээр өмчлөлийн болон төрийн бүрэн эрхийн онолын хүрээнд хүлээн зөвшөөрөгдөх боломжтой болохыг тогтоов. Түүнчлэн роялтийн онолын суурь болон түүний хэрэгжилтийн загварууд улс орнуудын бодлого, тухайн улсын Үндсэн хууль болон холбогдох хууль тогтоомжийн зорилго, зарчимд нийцсэн хууль тогтоогчийн сонголтоос хамааран ялгамжтай байх нь эрх зүйн хувьд зүй ёсны үзэгдэл болохыг харуулав. Энэхүү судалгаа нь Монгол Улсын ашигт малтмалын нөөц ашигласны төлбөрийн эрх зүйн зохицуулалтыг онолын болон практикийн түвшинд боловсронгуй болгоход хувь нэмэр оруулах ач холбогдолтой.
