Role of Judiciary in Public Policy and Evidence from Judicial Cases from 2011 Onward: A Critical Analysis

The Judicial role in an autonomous state like Pakistan has a main part to influence public intuitions & Policy. This Study has analyzed the role of Judiciary in public policy & has examined the role of judiciary in the public policy and its implication by critically analyzing the impact of judicial intrusions in the form of suo motu on public policy in Pakistan as well as the Suo-Moto impact on the Intuitional effectiveness. The researcher has adopted qualitative method and descriptive case study technique. 135 Suo-Moto cases from 2011- onward have been examined although, for the study, the researcher has taken six cases for critically analysis and discussion Suo-Moto Action by (SCP). The cases data have been fetched from the archives of SCP and by collecting the actual court documents of Suo-Moto cases. This study additionally analyzed the judgements of Suo-Moto cases effects the public policy. The results reveal that the suo-moto actions by SCP have no sustainable impact on the intuitional performance and situation of the institutions is persisted which has not been changed in spite of Suo-Moto actions. This study has recommended a balanced coordination among three organs of government that how these stakeholders of a government can engage in policy execution for public and national interest.
