Przeszłość i przyszłość filozoficznoprawnej idei praw człowieka (History and Future of the Idea of Human Rights)

Idea naturalnych, przyrodzonych praw człowieka kszałtowała się przez kilka wieków i mimo wielu ataków i krytyki pozostaje jednym z fundamentów współczesnych porządków prawnych. Jednakże, upadek wiary w metafizyczną wyjątkowość człowieka w świecie przyrody wydaje się przynosić nowe krytyczne wyzwania mogące w istocie podważyć filozoficzne podstawy pojęcia praw człowieka w ich obecnym kształcie. Czy więc idea praw człowieka w erze post-humanizmu skazana jest na przekształcenie w bardziej ogólną koncepcję praw podmiotowych służących ochronie moralnie doniosłych interesów istot etycznie zasługujących na taką ochronę? Artykuł krótko analizuje rozwój idei praw naturalnych, główne kierunki jej krytyki a także problem jej potencjalnego przyszłej ewolucji w kierunku zasadniczo odmiennej idei praw podmiotowych niezwiązanych ściśle z człowieczeństwem rozumianym jako przynależność do określonego gatunku biologicznego.
An idea of natural, inborn human rights has been developing for several centuries and despite many attacks and critiques remains one of foundations of the contemporary legal orders. Nonetheless, decline of faith in a metaphysical uniqueness of human beings in the rest of natural world seem to bring some new critical challenges that may actually undermine philosophical basis of the concept of human rights in its present form. Is thus an idea of human rights in the era of post-humanism doomed to transform into a more general notion of subjective rights dedicated to protection of morally relevant interests of all beings that ethically deserve such protection? The paper briefly examines the evolution of the idea of natural rights, its main critiques as well as the question of its possible future development into basically different idea of subjective rights detached from humanity as membership in a particular biological species.
