חופש הביטוי וזכות ההפגנה של עובדי ציבור: חוק הסיוג במבחן הזמן Freedom of Expression and the Right to Demonstrate of Public Employees: The Public Service (Restrictions) Law Revisited

<p dir="rtl"><b>תקציר בעברית: </b>סעיף 1(3) לחוק שירות הציבור (הגבלות על פעילות מפלגתית וגיוס כספים), התשי״ט–1959 מסמיך את הממשלה לקבוע קטגוריות של עובדי ציבור האסורים בהשתתפות בהפגנות או בתהלוכות בעלות אופי פוליטי. מאמר זה מציע בחינה ביקורתית של מסגרת משפטית זו—לרבות החוק עצמו והחלטות הממשלה המיושמות באמצעות התקשי״ר—הסדר שזכה עד כה לתשומת לב מוגבלת יחסית בספרות המשפטית ובפסיקה. במאמר נטען כי המצב המשפטי הקיים, שאינו מעודכן ויוצר עמימות, עשוי ליצור אפקט מצנן ופגיעה בלתי מידתית בחופש הביטוי ובזכות ההפגנה כמו גם בחופש העיסוק. התפתחויות אחרונות בישראל, ובהן המשבר החוקתי, מלחמת אוקטובר 2023 וגל המחאות שליווה אירועים אלה, מדגישות את הצורך לבחון מחדש את ההסדר. נוכח שינויים משפטיים, מוסדיים וטכנולוגיים משמעותיים שחלו במגזר הציבורי מאז חקיקת החוק לפני למעלה משישים שנה, נטען כי יש לשקול מחדש את האיסור הרחב על השתתפות בהפגנות המוטל על עובדים רבים בשירות הציבורי, כדי להתאימו טוב יותר לעקרונות דמוקרטיים ולהבנות עכשוויות של חופש הביטוי במקום העבודה.<br><br></p><p dir="ltr"><b>English Abstract: </b>Section 1(3) of the Public Service (Restrictions on Party Activity and Fundraising) Law, 1959 authorizes the government to determine categories of public employees who are prohibited from participating in demonstrations or marches of a political nature. This article offers a critical examination of this legal framework—including the statute itself and the government decisions implemented through the Civil Service Regulations—an arrangement that has received limited attention in legal scholarship and case law. I argue that the longevity and ambiguity of this framework may have generated a chilling effect, discouraging affected public employees from participating in demonstrations and reducing the likelihood of legal challenges. Recent developments in Israel, including the constitutional crisis, the October 2023 war, and the wave of protests accompanying these events, highlight the need to reassess the framework in light of its implications for freedom of expression and the right to protest. Given significant legal, institutional, and technological changes in the public sector since the law’s enactment more than sixty years ago, the article contends that the broad prohibition on demonstrations imposed on many public employees should be reconsidered in order to better align with democratic principles and contemporary understandings of expressive freedom in the workplace.</p>
