PORNOGRAFIA DE VINGANÇA COMO VIOLÊNCIA CONTRA A MULHER

Resumo: O presente estudo objetivou analisar uma nova modalidade de violência de gênero, a pornografia de vingança, e discutir a resposta da Polícia Judiciária a esse tipo de delito em Florianópolis/SC, em 2022. A pornografia da vingança é um crime que, embora não ocorra exclusivamente com mulheres, as vítimas são, em sua maioria, do sexo feminino, conforme verificado na coleta de dados desta pesquisa. A metodologia empregada foi de natureza bibliográfica e documental, utilizando-se procedimentos policiais instaurados para investigar os casos denunciados. A pornografia de vingança, como instrumento de reafirmação de dominação masculina, viola direitos fundamentais e essenciais do ser humano, atingindo diretamente a dignidade, a privacidade e a intimidação, que são direitos da personalidade. A legislação vigente ainda se mostra cuidadosa de eficácia para reparar os danos às vítimas e à sociedade, uma vez que a pena para esse crime não coíbe a prática delituosa. Como conclusões da pesquisa, destaca-se a classificação do delito como uma forma de violência de gênero, que atua como instrumento de dominação da sexualidade feminina, limitando a liberdade sexual, requisito de moralidade social. Além disso, a pornografia de vingança pode ser invisibilizada na apuração dos fatos pela Autoridade Policial, dada a coexistência de outras modalidades de violência de gênero no caso concreto, mais facilmente reconhecidas como violência doméstica. Por fim, o trabalho contribui para outras pesquisas na área policial, abordando um tema atual e sensível que viola direitos básicos constitucionalmente assegurados às mulheres. Abstract: The present study aimed to analyze a new form of gender violence, which is revenge pornography, and discuss the response of the Judicial Police to this type of crime in Florianópolis/SC in 2022. Revenge pornography is a crime that, although not exclusive to women, mostly affects female victims, as verified in the data collection conducted for this research. The methodology employed for the research was both bibliographic and documentary, using police procedures initiated to investigate the reported cases. Revenge pornography, as an example of an instrument for reaffirming male domination, violates sensitive and essential fundamental human rights, directly impacting the individual’s dignity and, specifically, their privacy and intimacy, which are aspects of personality rights. Current legislation is still lacking in effectiveness to address the damage caused to both the victim and society, as the penalties for this crime do not deter the criminal behavior. The research concluded that this crime should be treated as another form of gender violence, serving as yet another instrument of control over female sexuality and women in general, as it seeks to limit their sexual freedom, which, among other things, is a requirement for social morality. Additionally, revenge pornography may be rendered invisible during the police investigation, due to the coexistence of other forms of gender violence in the case at hand, which are more easily recognized as domestic violence. Finally, this study contributed to other police-related research on this highly relevant and sensitive topic, which violates basic rights constitutionally guaranteed to women.
