An Academic Analysis of the Ownership of State Gifts in the Light of Sharia Law

Human beings, by nature, are inherently social, a characteristic that leads to the formation of what we term as 'society' or 'civics.' To establish a society, individuals cannot thrive in isolation but require the support and interaction of others. The foundation of a community of individuals rests upon certain etiquettes and principles, guided by Islamic Sharia. Among these fundamental principles are mutual attachment, the exchange of gifts, and empathy.This article explores one of these core principles the 'exchange of gifts,' with a particular emphasis on state gifts. In recent times, state gifts have sparked considerable discourse across print and electronic media nationwide. Various perspectives have emerged in legal settings, leading to significant debate. This article aims to critically analyze these differing viewpoints.The following questions are addressed in light of Islamic jurisprudence:Does the state hold any individual rights over these gifts? Who is the rightful owner of such gifts the state or the individual?Is the purchase of these gifts by a ruler permissible under state law?
