Qualifying signs of crimes against sexual inviolability of minors

Encroachments on sexual inviolability of minors are one of the urgent and acute problems of the international community, a single State and the whole of humanity. This article is devoted to the scientific analysis of the current criminal legislation in terms of the study of qualifying signs for crimes that infringe on the sexual of the individual, especially in relation to minors, as well as minors.
The priority task of the criminal law of the Republic of Kazakhstan is legal protection and ensuring the safety of children's health from criminal encroachments. It is for this purpose that the Criminal Code of the Republic of Kazakhstan provides for criminal liability for encroachments on sexual inviolability of minors. It is very important to study the criminal law norms set forth by the legislation in the latest editions, as well as the problems of qualification of subjective and objective signs of the composition of this type of criminal offenses. However, there are no special scientific studies aimed at comparative analysis of the criminal legislation of the Republic of Kazakhstan for 3 years, as well as in comparison of the norms of criminal legislation of foreign countries.
The scientific and practical significance of the article lies in the fact that, based on the analysis of criminal legislation and a systematic study of the signs of the objective and subjective side of the composition of sexual crimes against minors, problematic aspects of the qualification of these acts were considered. The materials of the article contain conclusions and provisions that have a certain general theoretical significance for the science of criminal law. The methodological basis of the study is the method of legal analysis and comparison, statistical method, research method, etc.
The main conclusion based on the results of the study is the conclusion that a differentiated legislative approach, taking into account specialized legal acts, to the legal assessment of qualifying signs of crimes aimed at sexual inviolability of minors, complies with the principles of criminal law. We believe that measures to strengthen responsibility for the subject composition and to tighten the system of penalties for certain types of sexual crimes are currently justified.
