O PRINCÍPIO DA SUSTENTABILIDADE COMO PRINCÍPIO CONSTITUCIONAL

<p class="resumo">Sustentabilidade na atualidade é a palavra de ordem, no cenário nacional e internacional e ocupa papel de destaque, como a única alternativa, real, verdadeira, efetiva e global, para organizar a vida de todos os seres vivos no planeta e desse modo superar os riscos de nossa própria extinção. A Constituição da República Federativa do Brasil de 1988, a partir da Declaração de Estocolmo, reuniu diversos mecanismos de proteção ao meio ambiente, buscando dar efetividade ao compromisso de defesa e preservação da vida para as presentes e futuras gerações. Desse modo, a pesquisa busca identificar de que forma o princípio da sustentabilidade está inserido como direito fundamental à vida, ao ambiente ecologicamente equilibrado, “impondo-se ao Poder Público e à coletividade o dever de defendê-lo e preservá-lo para as presentes e futuras gerações”, como princípio constitucional da sustentabilidade. Para tanto, utilizou-se o método indutivo, operacionalizado pelas Técnicas do Referente, da Categoria, do Conceito Operacional e da Pesquisa Bibliográfica. Para alcançar os objetivos propostos, a abordagem do tema se inicia a partir da construção dos conceitos por meio das diversas conferência internacionais, seguindo-se para uma análise da legislação constitucional brasileira, que visa garantir o princípio da sustentabilidade em todas as suas dimensões.</p><p class="resumo"><strong>Palavras-chave: </strong>Sustentabilidade. Princípio Constitucional.</p><h3>SUSTAINABILITY AS A CONSTITUTIONAL PRINCIPLE</h3><div><p class="abstractCxSpFirst"><strong>Abstract: </strong>Sustainability is the watchword, on the national and international scene and occupies a prominent role as the only real, true, effective and global alternative to organize the life of all living beings on the planet and thus overcome the risks of our own extinction. The Constitution of the Federative Republic of Brazil of 1988, based on the Stockholm Declaration, brought together various mechanisms to protect the environment, seeking to give effect to the commitment of defense and preservation of life for present and future generations. In this way, the research seeks to identify how the principle of sustainability is inserted as a fundamental right to life, to the ecologically balanced environment, "imposing on the Government and the community the duty to defend and preserve it for the present and future generations "as the constitutional principle of sustainability. For that, the inductive method, operationalized by the Techniques of the Referent, the Category, the Operational Concept and the Bibliographic Research was used. In order to achieve the proposed objectives, the approach to the theme begins with the construction of the concepts through the various international conferences, followed by an analysis of the Brazilian constitutional legislation, which aims to guarantee the principle of sustainability in all its dimensions.</p><p class="abstractCxSpLast"><strong>Keywords: </strong>Sustainability.
