On Being Faithful to the “Practice”

This commentary responds to James W. Nickel’s chapter on assigning functions to human rights. After some critical analysis, the commentary uses Nickel’s chapter as a springboard for understanding the common idea, among philosophers of human rights, that a theory of human rights should be faithful to the practice thereof. The commentary identifies two possible motives for endorsing this idea, and offers some words of caution about each.
