The author of the chapter examines conditions, types, special features, legal consequences and other significant application aspects of simplified criminal proceedings in the Criminal Procedure Law. Simplified criminal proceedings are understood as different ways of completing criminal proceedings, when the person directing the proceedings, in compliance with the requirements laid down in the Criminal Law and the Criminal Procedure Law, directs the criminal proceedings in a manner that differs from the general criminal procedural order, taking into account the special features that simplify and speed up the course of pre-trial criminal proceedings and examination of the criminal case in court.
Simplified criminal proceedings do not in any way or aspect mean a reduction in the standard of presumption of innocence, that is, all reasonable doubts regarding guilt which cannot be eliminated shall be evaluated as beneficial for the person who has the right to defence. In criminal proceedings, all the general provisions of the Criminal Procedure Law, including the basic principles of criminal proceedings, shall be observed when advancing in simplified proceedings.
