‘Honor Killing’ Crimes in Pakistan: A Scenario Analyzed Under Legal and Human Rights Perspective
View through CrossRef
‘Honour Killing’ is a form of violence mostly committed in the form of murder by dominant family members (males) against females of the family which are alleged to harm the honor of the family. The concept of ‘honour killing’ was brought together by Dutch scholar for the first time in 1978 to differentiate killings under this concept from other forms of killings in different societies. In this research paper, different definitions of ‘honour killing’ have been reviewed to understand the concept. While reviewing the relevant literature, both legislative work and research work have been discussed from different countries. Forms of ‘honour killing’ practices in Pakistan are also discussed. Then I have tried to narrate legal provisions related to subject matter including both constitutional rights and penal laws. The concept of ‘honour killing’ with Islamic perspective has also been discussed and few case laws are also described relating to honour crimes in Pakistan. The article also discusses international obligations and bindings on Pakistan with respect to violation of fundamental human rights. At the end, I have given few suggestions to strengthen the system to prevent honour killing crimes in Pakistan.
