Trotz der wachsenden Bedeutung von Outbound-Investitionskontrollen fehlt es bislang an völkerrechtlich verbindlichen Regeln, die solche Maßnahmen untersagen. Weder WTO-Recht noch Investitionsschutzabkommen oder das Recht des Internationalen Währungsfonds enthalten explizite Beschränkungen für Kapitalexportkontrollen durch den Ursprungsstaat. Auch eine etwaige Unvereinbarkeit mit völkerrechtlichen Verpflichtungen hätte keine unmittelbare Wirkung auf die Gültigkeit nationaler oder europäischer Rechtsakte. Aus Sicht des Welthandelsrechts bestehen daher keine rechtlichen Hindernisse für eine Outbound-Investitionskontrolle.
