La Constitution de 1937, qui porte la marque personnelle de De Valera, diffère des constitutions irlandaises précédentes par la place qu'elle accorde à l'église catholique, et par la conception de l'ordre social qui y est exposée. Ces influences ne sont nulle part aussi évidentes que dans les articles concernant la famille et les femmes, et dans l'article 45 qui contient un nombre de directives sociales proches du programme politique du Fianna Fail. L'ampleur de la campagne qui a précédé le référendum de septembre 1983 sur l'avortement prouve à quel point une partie de l'opinion irlandaise entend encore faire de la constitution un programme national moral, autant que politique.
