‘Strong Case’: Macklin and the Law

This essay examines the legal knowledge of the Irish actor and playwright, Charles Macklin (1699?-1797). It traces significant moments in his encounter with the legal system. These include his trial for the murder of the actor Thomas Hallam in 1735; his antagonism with the actor-manager David Garrick in 1743 and two important legal cases in 1769 and 1770 which allowed Macklin to protect the performance copyright to Love à la Mode. It also examines his litigation, encouraged by lord chief justice, William Murray, Earl of Mansfield (1705-1793), against a riotous Covent Garden audience faction in 1774. The essay also sets out the crucial role played by the Irish playwright and lawyer, Arthur Murphy (1727-1805), acting as Macklin’s legal adviser. Their association in the early 1770s, enables the identification of a specific London Irish diaspora linking the worlds of theatre and the law.
