Time for Extradition

Abstract
This chapter deals with the time for extradition in Part 1 cases. This covers time for extradition where there is no appeal, and agreement of a later date. Failure to extradite within the required period and applications for discharge are explained. Time for extradition where the defendant ‘appeals’, and when extradition has been deferred, are also considered. Undertakings from Part 1 territory concerning a person serving a sentence are also dealt with. Time for extradition in Part 2 cases is dealt with separately, that is, time for extradition where there is no ‘appeal; time for extradition where there has been an appeal; time for extradition where undertakings are sought from a requesting state; and time for extradition following deferral for a competing claim.
