RESUMOO cerne da problemática ora analisada encontra-se na valoração do inquérito policial e na utilização das provas obtidas nesta fase processual, notadamente na ocasião da fundamentação das decisões proferidas pela autoridade policial e pelo juiz, com o propósito de evidenciar o investigado como um sujeito de direitos. É feita uma análise do contraditório prévio e diferido como ferramentas de validação das provas obtidas no inquérito para a finalidade de motivar decisões restritivas de direitos fundamentais. É demonstrada a importância da tomada de medidas que auxiliem na correta produção de provas durante o inquérito policial, submetendo estas provas, sempre que necessário, ao contraditório simultâneo ou prévio, garantindo direitos fundamentais básicos do sujeito passivo. Palavras-Chave: Inquérito Policial. Livre Convencimento Judicial Motivado. ABSTRACTThe core of the problem analyzed here is the evaluation of the police inquiry and the use of evidence obtained during the procedural phase, especially on the merit of decisions given by the police authority and by the judge, for the purpose of makes clear that the person under investigation is also someone with rights. We make an analysis of deferred and previous contradictory, as tool of the validation of evidences obtained in the inquiry for a purpose of motivating decisions that make restrictions on the fundamental rights. It’s demonstrated the importance of taking measures for the production of evidence during the inquiry by submitting such evidence, where necessary, to the simultaneous or previous contradictory, guaranteeing the basic grounds to the passive subject. Keywords: Police Inquiry.
