RESUMOO objetivo deste trabalho é analisar o voto-vista do Ministro Barroso e desvelar se ocorreu ativismo judicial e se houve respeito às regras do jogo democrático e, ao final, de acordo com o pensamento de Lenio Streck, analisar uma forma de evitar o ativismo judicial. Serão levantados os conflitos no voto sob análise e revelados os pontos de claro ativismo judicial. Para serem alcançados os objetivos da presente pesquisa será utilizado o método analítico e a técnica de pesquisa bibliográfica. Palavras-chave: Ativismo judicial. Hermenêutica. Direito. ABSTRACT The objective of this study is to analyze the Minister Barroso view-vote and reveal if there was judicial activism or whether respect for the rules of the democratic game and at the end, according to the thought of Lenio Streck, analyze a way of avoiding activism judicial. Conflicts will be raised in the analyzed vote and revealed the points of clear judicial activism.
