Legal Recognition and Lived Realities of Intersex (Khawaja Sira) Persons in Pakistan

Intersex (Khawaja Sira) persons in Pakistan have historically occupied a visible yet marginalized position within society. Although recent judicial and legislative developments have attempted to recognize and protect their rights, intersex (Khawaja Sira) persons continue to face social exclusion, discrimination, and barriers to accessing basic rights. This paper examines the legal framework governing intersex (Khawaja Sira) persons in Pakistan and explores the challenges they face in practice. Drawing on doctrinal legal analysis and qualitative data collected during the author's undergraduate LL.B thesis research, the study identifies gaps between formal legal recognition and lived realities. The findings reveal that despite constitutional guarantees and statutory protections, weak implementation, social stigma, and administrative resistance undermine effective protection. The paper argues that legal reform alone is insufficient and must be accompanied by institutional accountability and social awareness. It is hoped that this study can contribute to ongoing discussions on intersex (Khawaja Sira) rights and inform future legal and policy reforms in Pakistan.
