ԻՐԱՎՈՒՆՔԻ EXTRA LEGEM ԵՎ CONTRA LEGEM ԶԱՐԳԱՑՈՒՄՆ ՕՐԵՆՍԴՐԱԿԱՆ ՓԱԿ ՑԱՆԿԵՐԻ ՊԱՐԱԳԱՅՈՒՄ / EXTRA LEGEM AND CONTRA LEGEM DEVELOPMENT OF LAW IN THE CASE OF LEGISLATIVE CLOSED LISTS

The article examines poorly studied issues of legal theory, such as the silence of the legislator, closed legislative lists, and the “opening” of these lists with the help of contra legem logic or the replenishment of these lists with the help of extra legem logic. To clarify the terms, the author identifies two manifestations of legislative silence (legislative gap), namely, the omission of the legislator and the deliberate silence of the legislator. Legislative gap is not only a consequence of the omission of the legislator, but also a result of the deliberate silence of the legislator.
