دراسة الإتجاه الفقهي الحديث في التفسير: قضيّة تعدّد الزوجات أنموذجًا

Scholars agree that the established Sharia aims to provide benefits to humans. Although polygamy has existed for a long time in human practice, Islam neither aims to absolutely prevent it nor does it allow it without conditions. Therefore, the legalization of polygamy in Islam involves setting forth conditions and guidelines that must be followed. Misunderstanding of this legislation is not only found among the general public who may not fully comprehend the law or the verses, but it also arises from a misinterpretation of the verses related to the topic. This has led to the proliferation of various suspicions regarding the issue of polygamy, deviating from the true interpretation and understanding of the verses. This study analyzes a new perspective in interpreting ayah ahkam, emphasizing social issues, particularly those related to polygamy, in an effort to address the misunderstandings surrounding the Hukm. This study found that interpreter and scholars in general, not only discuss the jurisprudential aspects found in the Hukm of polygamy but also talk about the significance of that legislation to society. Although some of them may overstep in interpreting that legislation, many other interpreter remain fair in discussing the legislation of polygamy including address the doubts arising in society regarding its laws to manifest the role of the Quran in reforming society.
