Formation and development of a preventive measure in the form of house arrest in the history of the state

. В статье проводится ретроспективный анализ становления и развития меры пресечения в виде домашнего ареста, а также нормативной правовой базы, регламентирующей порядок ее избрания. На основе анализа исторической литературы, законодательных нормативных правовых актов, а также архивных материалов автором рассмотрены вехи развития рассматриваемой меры пресечения, что позволило выделить 4 хронологических этапа. В статье указаны недостатки, возникающие в результате избрания домашнего ареста в различные исторические периоды, одновременно с этим предлагается перенять исторический опыт законодателя в части получения дополнительных ассигнований в доход государства, в случае избрания указанной меры пресечения. Результатом исследования установлено, что процесс становления мер пресечения начинался от отсутствия четкой дифференциации мер пресечения, зависимости избрания меры пресечения от решения судьи или судебного следователя, а не от нормы закона, до гуманизации норм уголовно-процессуального законодательства, строгой регламентации порядка применения мер пресечения. The article provides a retrospective analysis of the formation and development of a preventive measure in the form of house arrest, as well as the regulatory legal framework governing the procedure for its election. Based on the analysis of historical literature, legislative normative legal acts, as well as archival materials, the author considers milestones in the development of the preventive measure under consideration, which allowed us to identify 4 chronological stages. The article points out the shortcomings that arise as a result of the election of house arrest in various historical periods, at the same time it is proposed to adopt the historical experience of the legislator in terms of obtaining additional allocations to the state revenue, in case of the election of this preventive measure. The result of the study found that the process of formation of preventive measures began from the absence of a clear differentiation of preventive measures, the dependence of the election of a preventive measure on the decision of a judge or a judicial investigator, and not from the rule of law, to the humanization of the norms of criminal procedural legislation, strict regulation of the procedure for the application of preventive measures.
