The scientific contribution deals with the physical and legal constitutional complaint stated by Article 127 of the Slovak Republic Constitution. The attention is specifically put on the proceeding provided by the Constitution Court concerning the constitution complaint including the preliminary rehearing. The time aspect is mainly analyzed as regards the timely complaint submission and at the same time accentuating to grant the constitutional legal protection in connection with the objected rights. In this context, it is needed to take into consideration not only the ultimate two months’ time-limit to lay down the complaint, but the specific facts as well, for instance there might be the factual basis of the law infringement or the length of the objected encroachment. Only under the preconditions of the basic attributes fulfilment, it is acceptable acknowledgment that the lawful requirements of the constitution complaint have been met.
