Abstract
Expropriation in international investment law is generally the most frequently invoked, intensely debated, and best understood principle. Some of the most frequently cited expropriation rules involve Africa treaties and cases. This chapter conducts a deeper inquiry into the evolution of the African states’ position on expropriation in light not only of investment treaty cases but also in reference to the Libyan Oil cases, as they are considered the foundation cases of the modern law of expropriation in international arbitration. Tracing the evolution, this chapter seeks to underscore the communality of positions of the African states on this issue and how the jurisprudence influenced contemporary legal doctrine and textual articulation in modern treaties.
