Il neonato: un apolide morale

L’approccio etico al trattamento del neonato è nettamente diverso da quello verso l’adulto soprattutto in tre campi: la rianimazione, il trattamento del dolore, l’esecuzione di studi scientifici. Questo dipende in buona parte da un differente stato morale del neonato, che possiamo chiamare di “apolidia morale”, uno stato in cui ancora – esplicitamente o implicitamente – non sono riconosciuti al bambino nato pieni diritti. Due sono i motori di questa incertezza: un’estensione al neonato dello stato di non-persona in cui molte legislature relegano il feto e un ostacolo verso una piena cittadinanza dovuto all’assenza di autonomia. Il fenomeno indica una subordinazione dell’essere umano all’ingresso nel novero dei “cittadini” legata all’“accettazione” da parte di terzi, che si estende per alcune caratteristiche anche oltre l’epoca neonatale. ---------- The ethical approach for treatment of newborn differs from that reserved to the adult in three main areas: intensive care, pain management, and scientific studies. This greatly depends on a different moral status of the newborn, that we call “moral statelessness”, a state in which full rights are yet explicitly or implicitly denied to the child. The sources of this uncertainty are two: an extension of non-person state to the newborn and an obstacle to full citizenship due to lack of autonomy. This phenomenon indicates that personhood is subordinated in some cases to the “acceptance” by third parties, which in some cases exceeds the neonatal period, as it will be discussed in the text.
