Статья посвящена анализу принципа пропорциональности (соразмерности) ограничения прав и свобод человека. Анализируются доктринальные источники, а также законодательство. Обращается внимание на необходимость определения понятий «закон», «правомерные цели». Высказано суждение о том, что с учетом сложившейся в Беларуси практики понятие «закон» в контексте статьи 23 Конституции необходимо рассматривать в широком аспекте, включая в него все законодательные акты, а также с учетом новых реалий, акты Всебелорусского народного собрания
