Diversion e criticità costituzionali: l'ibridazione fra (ri)educazione e retribuzione nella "prova semplificata"

L'autore analizza il nuovo "percorso rieducativo del minore", introdotto dal decreto legge n. 123/2023, convertito in legge n. 159/2023, nel corpo del Dpr n. 448/1988 (relativo alla disciplina del processo penale minorile, art. 27-bis) e integrante una sorta di sospensione del procedimento con messa alla prova semplificata e anticipata. L'autore evidenzia, in particolare, le principali (e non poche) criticità dell'innovativo istituto, che conducono anche a rilevanti dubbi di legittimità costituzionale per contrasto con i principi fondamentali sui quali si fonda l'intero sistema processuale penale minorile.
