Sanction for Counsel in the Sheriff Court

This chapter deals with the recovery of the fees of counsel or Solicitor Advocates in a judicial account of expenses and the necessity of having Counsel’s involvement sanctioned by the Sheriff in Sheriff Court proceedings. The test for sanction of the cause or particular parts of the cause is explained as is the particular requirements in relation to involvement of Senior Counsel. The need for prospective and/or retrospective sanction depending on the rules governing the litigation are covered as is the question of Counsel’s entitlement to cancellation fees or disappointment fees where Proofs or Hearings do not proceed.
